It depends almost entirely on whether you and your spouse agree. An uncontested divorce, where the terms are settled between you, can often be resolved in a matter of months. A contested matter involving custody, support, or complex assets usually takes longer — sometimes a year or more. At your consultation we'll give you a realistic range for your situation rather than an optimistic one.
Often, no. Many matters are resolved through negotiation between counsel, and some are well suited to mediation. Court becomes necessary when you can't reach agreement, or when temporary orders for support or custody are needed while the case is pending. If yours does go before a judge, our office is directly across the street from the Nassau County courthouses.
New York courts decide custody according to the best interests of the child, weighing stability, each parent's involvement and ability to provide care, the child's needs, and how the parents communicate. There is no automatic preference for either parent. Parents can also agree on an arrangement and submit it for approval, which is typically faster, less expensive, and far less damaging than litigating.
New York applies a statutory formula under the Child Support Standards Act, based on a percentage of combined parental income that begins at 17% for one child and rises with the number of children. Costs such as childcare, health insurance, and education are generally addressed separately, and a court can adjust the formula result where it would be unjust or inappropriate.
New York divides marital property equitably — fairly — which does not always mean equally. Property acquired during the marriage is generally marital, while assets you brought into the marriage or inherited may remain separate. A family home, retirement accounts, and closely held businesses each call for their own analysis, and how they're valued often matters as much as how they're divided.
